href=\"https:\/\/en.wikipedia.org\/wiki\/Law_of_the_United_States#Federal_law\">federal law<\/a> enacted in 2018, that asserts U.S. data and communication companies must provide stored data for a customer or subscriber on any server they own when requested by warrant from a US law enforcement agency. However, the act contains mechanisms for the companies or the courts to challenge these if they believe the request violates the privacy rights of the foreign country the data is stored in.<\/p>\n\n\n\n<p class=\"kt-adv-heading12826_2423dc-b4 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_2423dc-b4\">However, the act contains mechanisms for companies or courts to challenge such requests if they believe the request violates the privacy rights of the foreign country where the data is stored.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-group blockera-block blockera-block-1gi7r1i is-vertical is-layout-flex wp-container-core-group-is-layout-b2c973f4 wp-block-group-is-layout-flex\">\n<h2 class=\"kt-adv-heading12826_ad98df-b5 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_ad98df-b5\">Cloud Act vs GDPR<\/h2>\n\n\n\n<div class=\"wp-block-group blockera-block blockera-block-vssaat is-vertical is-layout-flex wp-container-core-group-is-layout-90752e8f wp-block-group-is-layout-flex\">\n<h3 class=\"kt-adv-heading12826_919017-bc wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_919017-bc\">Concerns from EU authorities<\/h3>\n\n\n\n<p class=\"kt-adv-heading12826_84f5dd-79 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_84f5dd-79\">The <a href=\"https:\/\/en.wikipedia.org\/wiki\/European_Data_Protection_Supervisor\">European Data Protection Supervisor<\/a> (EDPS) and the European Data Protection Board (EDPB) view the Cloud Act as a law that may conflict with the <a href=\"https:\/\/en.wikipedia.org\/wiki\/General_Data_Protection_Regulation\">GDPR<\/a>. They have conducted an official review of the act.<\/p>\n\n\n\n<p class=\"kt-adv-heading12826_4b0daf-af wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_4b0daf-af\">They highlight that Article 48 of the GDPR requires that any order from a non-EU authority requesting the transfer of personal data outside the EEA must be recognized by an international agreement (such as an MLAT) to be valid.<\/p>\n\n\n\n<p class=\"kt-adv-heading12826_f8931c-69 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_f8931c-69\">A quote from the official report states:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote blockera-block blockera-block-12qx3x0 is-layout-flow wp-block-quote-is-layout-flow\" style=\"border-left-color:#0d875c\">\n<p class=\"blockera-block blockera-block-11uvrni has-manrope-font-family\" style=\"font-size:clamp(14px, 0.875rem + ((1vw - 3.2px) * 0.227), 16px);\">\u201cWe are of the view that currently, unless a US Cloud Act warrant is recognised or made enforceable on the basis of an international agreement, the lawfulness of such transfers of personal data cannot be ascertained\u2026\u201d<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"kt-adv-heading12826_9ca378-91 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_9ca378-91\">Need for international agreements<\/h3>\n\n\n\n<p class=\"kt-adv-heading12826_e2cc73-10 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_e2cc73-10\">Because of this, EU authorities have proposed that it is urgent to create new MLATs between the EU and the US so the Cloud Act can be incorporated into the EU\u2019s legal framework, which it currently is not.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group blockera-block blockera-block-1gi7r1i is-vertical is-layout-flex wp-container-core-group-is-layout-b2c973f4 wp-block-group-is-layout-flex\">\n<h2 class=\"kt-adv-heading12826_36ce2b-1c wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_36ce2b-1c\">Challenges for Organizations<\/h2>\n\n\n\n<div class=\"wp-block-group blockera-block blockera-block-1c0eemm is-vertical is-layout-flex wp-container-core-group-is-layout-90752e8f wp-block-group-is-layout-flex\">\n<h3 class=\"kt-adv-heading12826_3aef0b-8c wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_3aef0b-8c\">Jurisdiction issues<\/h3>\n\n\n\n<p class=\"kt-adv-heading12826_532a60-29 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_532a60-29\">Many organizations fall under U.S. jurisdiction, including:<\/p>\n\n\n\n<ul style=\"font-size:clamp(14px, 0.875rem + ((1vw - 3.2px) * 0.227), 16px);font-style:normal;font-weight:500\" class=\"wp-block-list blockera-block blockera-block-1sc661f has-manrope-font-family\">\n<li>Businesses using cloud storage solutions owned by U.S. companies<\/li>\n\n\n\n<li>EU organizations with U.S. customers or subscribers<\/li>\n<\/ul>\n\n\n\n<p class=\"kt-adv-heading12826_1910a0-4d wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_1910a0-4d\">This creates complex legal exposure.<\/p>\n\n\n\n<h3 class=\"kt-adv-heading12826_3c90c6-52 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_3c90c6-52\">Legal conflict<\/h3>\n\n\n\n<p class=\"kt-adv-heading12826_19d1af-a5 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading12826_19d1af-a5\">An EU-based company that complies with a U.S. warrant requiring transfer of personal data may be in breach of Articles 44 and 48 of the GDPR if no international agreement exists.
